General Conditions of Sale (GCS)

1. Definitions
SGS: the company Summit Global Supplies S.r.l. (VAT no 01621980893) unipersonale with registered office at Via Montorsoli, 52/A – 96100 Siracusa (Italy);
Buyer: the Consumer sending an order telematically to SGS and/or who has entered into a sale contract with it regarding the purchase of the Product;
Product: the PAMPA Set comprising the instruments and indicated in the GCS;
Consumer: any individual acting for purposes outside that of his commercial, industrial, artisanal or professional activity;
Website: meaning www.pampalavastone.com website.

2. Information provided Pursuant to Art. 12 Legislative Decree no. 70/2013
2.1) SGS wishes to make available to the Buyer the following information:
a) The various technical phases to be followed in order to conclude the contract are :
– access the section “Purchase”: state the number of products and material from the relevant tray/s to be chosen (the product/s is/are added to the “shopping basket”);
b) The contract once entered into is archived and can be accessed as follows;
– When sending an order a summary of this is provided by email (whether or not the user is registered); accessing the “reserved” area one can see the summary under the heading “Orders” (only of the customer at time of checkout agreed to the creation of an account); the order is not binding on SGS, and therefore confirmation must be received in accordance with the GCS;
c) The technical means made available to identify and correct the errors in data insertion prior to forwarding the order to SGS:
– access the section “Checkout”, prior to confirming the order it is possible to review and/or amend one’s data without leaving the page or go back .
d) any codes of conduct applied and how to access these telematically;
– SGS does not apply any code of conduct.
e) Languages available in which the contract can be entered into in addition to English :
– The sales contract can be entered into in Italian, French, Spanish and German.
f) The indication of the manner of resolving disputes:
The contract is subject exclusively to Italian law;
for Consumers who are resident or electively domiciled outside the territory of the Italian State, the court competent, exclusively, to decide any disputes is the Court of Syracuse; for Consumers resident or electively domiciled within the territory of the Italian State, the competent court will be the court of their residence or their domicile of choice.

3. Scope of application – Acceptance of the General Conditions of Sale
3.1) These General Conditions of Sale (“GCS”) discipline the conditions applicable to all orders sent and to all contracts entered into online between SGS and the Buyer within the eCommerce system offered and managed by SGS on the www.pampalavastone.com website.
These GCS may be amended at any time and without notice by SGS and will be binding on the Buyer from the date of their publication.
The Incoterms 2013 as duly referred to in these GCS form an integral and substantial part of the contractual relationship.
3.2) The sales system is directed towards Consumer.
3.3) The Buyer, in sending an order telematically: (i) confirms that he has viewed the GCS and that he accepts them and (ii) waives the application of any of his own purchase conditions.
3.4) Orders will not be accepted if sent from non EU States or where the delivery is to a non EU State, save for the United Kingdom.

4. Registration – user Id and Password – hold harmless
4.1) Registration on the Website is not obligatory. The Buyer intending to send, telematically, an order can however register himself completing the relevant registration form on the Website.
The Buyer undertakes to provide his personal data in a correct and truthful manner and to timely notify any changes of the same. The processing of the Buyer’s personal data – provided and collected at the time of registration and/or performance of the contract – is effected in accordance with the personal data processing notice of SGS as referred to at clause 14.
4.2) At the time of registration, the Buyer will chose a User ID and a Password. Thereafter, SGS will send via email confirmation of registration, summarising the Buyer’s details as well as the User ID chosen and will permit the relevant access to the personal control panel in order to be able to make further orders, subject to IT authentication, and to follow the course and various phases of the orders placed.
4.3) The password and User ID can be changed by the Buyer at any time.
4.4) The identification codes (User ID and Password) must obligatorily be used each time the Buyer wishes to use the service or review orders sent and filled, for the purpose of authentication.
The Buyer acknowledges and agrees that the User ID and Password are the only suitable means of identifying the Buyer when accessing www.pampalavastone.com; therefore all actions carried out using said identification codes will be attributed to him and will be binding on him.
4.5) The Buyer undertakes to safeguard his User ID and Password with the maximum confidentiality and diligence, taking into account the nature and characteristics of the service and not to transfer these, even on a temporary basis, to third parties.
4.6) SGS reserves the right to suspend the access and sales service:
if the Buyer provides data that are inexact or incomplete; in that case the access to the Website will be deactivated until such time as the Buyer makes the amendments or updates as requested;
if credit institutions, banks or cardholders raise objections regarding the payment made by the Buyer;
if the Buyer uses the system in an inappropriate manner.
4.7) The Buyer will be considered the sole person responsible for any acts, damages, whether direct or indirect, or loss connected, directly or indirectly, with the copying, knowledge, dissemination, communication and use, also by unauthorised or abusive third parties, of his User ID and Password.
4.8) The Buyer will indemnify SGS in respect of any claim, action or objection that may be made against SGS in relation to the facts indicated at art. 4).
4.9) The Buyer registering on the Website will be asked to give consent for the use of personal data for promotional purposes (sending a newsletter).

5. Components (Instruments & ) of the PAMPA Set Product
5.1) The PAMPA Set Product is always sold including the Instruments and (as hereinafter defined).
5.2) The components of the PAMPA SET Product – Instruments, are as follows;
Lava Stone cooking plate – standard (30x30x2cm), stainless steel support-frame, Borosilicate glass tray or PTFE tray (at the Buyer’s option);
5.3) The components of the PAMPA SET Product – , are as follows:
2-off 100% cotton potholders, metal heat diffuser, cleaning kit composed of 2 elements, cutting board in betula wood.

6. Nature of invitation to treat – Price and Costs
6.1) The publication of the images of the PAMPA Set Product including Instruments and – and indication of the price – constitute a mere invitation to treat. The order sent by the Buyer is therefore not in any manner binding on SGS, which reserves the right to verify the availability of the individual components of the PAMPA Set Product: instruments and .
6.2) The PAMPA Set Product and relevant Instruments and are in fact subject to machining and exclusive production process following to the order.
6.3) SGS, once the order is confirmed and subject always to successful and complete payment, will commence the:
machining (lava stone) and subsequent surface treatment pursuant to the innovative characteristics subject to a patent application currently pending in Italy.
exclusive production to order (no stock) of all the Instruments and of the PAMPA Set.
6.4) Should there be Product stock in the warehouses, in case of returns of the Product by the Buyer exercising his withdrawal rights (art. 11) or in case delivery is not made when the addressee cannot be reached (art. 9.5), the Product will be available in a shorter period than that stated in the contract. In that case, prior to being offered for sale to the Buyer, the Product integrity and operation will be verified and the Buyer will be asked whether he is willing to accept the same.
The price of the Product is stated inclusive of VAT. Additional shipping costs and optional insurance costs are indicated apart from the sales price.
If it is not possible to effect the working stated at art. 6.3 and the supply of the Product for reasons due to third party suppliers, following order confirmation, SGS will be entitled to terminate the contract with the Buyer, save always the return to the Buyer of the sum paid, and SGS will therefore be free of any further obligations from the date of effective reimbursement of any price paid.

7. Conclusion of Contract
7.1) All orders sent – electronically – are subject to verification of availability and acceptance. The sending of the order by the Buyer has, therefore, the value of a mere offer, pursuant to art. 1326 civil code, and will in no way be binding until such time as it is fully accepted. SGS will be – in fact – free to accept orders or otherwise, reserving the right to check the availability of the Product. In the event that the Product is not available, or for some reason the order cannot be processed, SGS will promptly notify the Buyer.
7.2) SGS will communicate its eventual acceptance within 3 (three) working days from receipt of the order by sending a confirmation eMail in which, pursuant to art. 13 of Legislative Decree 70/2003, all the essential characteristics of the Product, the price, the information in order to make the payment by bank transfer and other essential terms will be summarized; the GCS will be attached. Subsequently (once the order is confirmed):
– in case of payment to be made by Bank Wire Transfer, upon receipt of the order’s acceptance sent by eMail, the Buyer must immediately provide for payment by bank transfer, which payment must be credited to SGS account within the 3 working days following the communication of the acceptance of the order. The contract of sale is conditioned (and therefore subject to termination) on full payment. Therefore, failure to credit the current account of SGS in the aforementioned period, for any reason attributable to the Buyer, will result in the termination of the contract, the order will be cancelled and the Buyer will have to reinsert said order, with release of SGS from any obligation.
7.3) The Product will be delivered to the courier for shipment to the Buyer within:
– 40 working days (eight weeks) from the completion of payment (booking of the payment); or
– 3 working days from the completion of payment (booking of the payment), in case of availability of the Product in the warehouse, as indicated in art. 6.4, where delivery of the Product has been accepted by the Buyer.
7.4) Once the Product has been delivered to the shipper, the following timeframe is required as extra:
– further 2-3 working days in case of delivery in Italy;
– further 4-5 working days in case of delivery within the European Union.

8. Payment Terms
8.1) The Buyer may choose any of the following payment methods.

b. Bank Wire Transfer
SGS will send the bank details in order to make the payment along with the eMail confirmation accepting the order.

9. Shipping Terms and Costs
9.1) Delivery of the Product to Italy, to the Republic of San Marino and to the Vatican City is carried out by DHL courier according to the General Conditions of Sale, to which reference is made and which are deemed as an integral and substantial part hereof.
The shipping costs of the PAMPA Set Product are as follows and are charged at the time when the contract is entered into (acceptance of the order by SGS).
The standard shipment of the PAMPA Set Product consisting of the Instruments and together, to the Consumer in the Italian territory, including Republic of San Marino and the Vatican City, is FREE OF CHARGE.
The delivery time of the PAMPA Set Product is as follows (from date of delivery of the Product to the forwarding agent):

2-3 working days in case of delivery to Italy (including Republic of San Marino and to the Vatican City).

9.2) The delivery of the Product within Europe is made by DHL courier according to the General Conditions of Sale, to which reference is made and which are deemed as an integral and substantial part hereof.
The shipping costs of the PAMPA Set Product consisting of the Instruments and together, to Consumer in the European Union (EU), are as follows and are charged at the time when the contract is entered into (acceptance of the order by SGS).
Standard shipment for delivery to EU countries (including United Kingdom), € 42,22 (VAT included).
Standard shipment for delivery to Norway and to Switzerland, € 45,64 (VAT included).
The delivery time of the PAMPA Set Product is as follows (from date of delivery of Product to the forwarding agent):
4-5 working days in case of delivery within the EU.

9.3) The packages are correctly sealed with adhesive tape stating [guarantee strip] “Sigillo di Garanzia”. If for any reasons the package appears to have been tampered with, the Buyer will have to sign the bill of lading at receipt with reserve, or may refuse to accept the goods. The Buyer must immediately report the incident to the local office of the courier responsible for delivery and contact SGS at the following eMail address: customerservice@pampalavastone.com.
9.4) Without prejudice to the above, the Buyer is obliged to verify at the time of delivery the full compliance of the indications in the bill of lading with the actual number of packages and the apparent state of the goods and their packaging, thus taking care to indicate – in case of discrepancies – the relevant remarks on the bill of lading. In the absence of reasoned remarks, it is presumed that upon receipt, the goods and their packaging were in apparent good order and that the number of packages, their markings and their references were compliant with the indications stated in the bill of lading.
9.5) If for any reason the delivery cannot be successfully carried out up to the address provided by the Buyer and the parcel must be sent back to SGS, the same will be returned and the cost charged to the Buyer.
9.6) Deliveries from SGS can be optionally insured against theft and accidental damage according to the General Conditions of Sale. Once the shipment reaches its destination, the insurance loses its validity. The cost of (optional) insurance is Euro 12.20 (VAT included). By the signature at delivery, the responsibility for the goods is transferred to the Buyer. The person who signs, in fact, confirms that he has received the package and is responsible for the package itself.

10. Status of the Order (accepted by eMail confirmation)
10.1) The Buyer can verify the status of his order directly on the control panel for his personal profile, as indicated at art. 2).
10.2) At the time of shipment, SGS and/or the courier will send the Buyer an e-mail or an SMS containing the shipping number provided by the DHL courier. The Buyer can follow the status of his order sent directly to the control panel of his personal profile or on the courier’s site. The displayed web page will show the exact and updated movements regarding the shipment.

11. Consumer Withdrawal Right (Returns)
11.1) According to legislative decree dated 6 September 2005, n. 206 (Consumer Code), in accordance with the provision of art. 47) of the same, the Consumer can freely exercise, and without need to ground the same, the right to return the purchase, by sending written notice to Summit Global Supplies S.r.l., Via Montorsoli 52/A – 96100 Siracusa (Italy) by registered letter with proof of delivery within fourteen (14) working days from the date of the receipt of the purchased Product, pursuant to articles 64 and 67 et seq. Consumer Code (Saturdays, Sundays and public holidays are not working days).
11.2) The right of withdrawal may also be exercised, within the same term, by telegram, or by fax sent to 0039 0931 209832 or by eMail sent to customerservice@pampalavastone.com, provided the same is confirmed by registered letter with proof of delivery within the following forty-eight working hours. The registered letter is deemed sent in good time if delivered to the post office within the time limits stated in the Consumer Code and indicated above.
11.3) The Buyer can also electronically fill in and send the withdrawal form or any other explicit declaration on the pampalavastone.com website by clicking on the “Return” icon, in the Personal Profile, in the “My Orders” section. SGS will transmit by e-mail without delay an acknowledgment of receipt of the withdrawal.
11.4) In all cases, the costs of sending the registered letter and fax and any other ancillary or additional expenses are borne by the Buyer. The Product must be returned to Summit Global Supplies S.r.l., Via Montorsoli 52 /A – 96100 Siracusa (Italy), no later than fourteen (14) working days from the date of receipt by SGS of the withdrawal notice. For the purpose of expiry of the term, the goods are considered as returned when they are delivered to the accepting post office or to the forwarder. Returns received after the contractual terms have expired may not be accepted at the discretion of SGS. For shipping it is advisable to use a courier or other means suitable to allow the traceability of the shipment.

11.5) SGS will refund the price of the returned Product once the integrity of the same and its normal state of conservation have been ascertained. In this case, within fourteen (14) working days from receipt of the notice of withdrawal sent by registered letter with proof of delivery, and after checking the integrity of the Product, SGS will proceed to credit the Buyer with the amount corresponding to the value of the goods stated in the invoice, excluding shipping costs borne by SGS (including additional costs arising from the possible choice of the Buyer to use a form of delivery other than the less expensive method of standard delivery applied by SGS). Unless otherwise agreed, the refund will be made using the same payment method used by the Buyer to make the payment.

ATTENTION:
The costs for returning the Product and any additional accessory or additional expenses are charged to the Consumer (NO RETURNS WILL BE ACCEPTED WITH SHIPPING COSTS CHARGED TO SGS).
The Buyer must send the Product properly packaged in the original packaging and must also include a copy of the delivery / transport document received. In the event that the delivery / transport document was lost during shipment, the Buyer can request a copy from SGS by contacting: customerservice@pampalavastone.com.
The right of withdrawal can be exercised only if the Product is perfectly UNDAMAGED in every part [including the declaration of conformity (where provided) and the corresponding serial number stamped on the hologram sticker and the labels, catalogues, packaging and original received together with the order] and in a normal state of preservation. The returned Product must not be removed from its wrapping or parts of the same, nor show signs of tampering. If SGS should receive the return Product tampered with or damaged or used improperly, it will not refund the amount paid for the purchase of the same and the Product will be returned to the Buyer at its expense.

12. Product Legal Warranty
12.1) SGS guarantees that the Instruments and as part of the PAMPA Set Product will be free of any defects in conformity.
Conformity defects are those that render the Product:
Unsuitable for normal use or the use to which items of the same nature are normally put;
Not conforming to the description provided by SGS;
Lacking in the usual qualities for an item of the same type that the Consumer may reasonably expect, taking into account the nature of the item and any specific Product guarantees provided by SGS.

12.2) The legal guarantee pursuant to Article 1495 of the Civil Code, shall be for a term of:
Two (2) years from the date of delivery of the Product to the Consumer and must be claimed against within two (2) months from the discovery of the defect (in the case of apparent defects, the discovery coincides with the delivery). It is therefore always necessary to keep proof of the purchase.

12.3) SGS will take delivery of the defective Product to check whether or not the malfunction depends on a lack of conformity. In particular: (i) for defects occurring during the first six months from the date of delivery of the Product, the cost of verification is always borne by SGS as it is presumed that the defects existed at the time of delivery; (ii), thereafter, in the sole case where the malfunction does not depend on a defect in conformity, SGS can request reimbursement of the reasonable cost of Euro 50.00 for verification. If a defect in conformity is identified, SGS will repair or replace the goods within a reasonable time from the request and without charging any expenses. In the presence of a defect in conformity, the Consumer is entitled, at his option, to repair or replacement by SGS of the defective item without charging any expenses, unless the remedy requested is impossible or excessively burdensome with respect to the other option. If replacement or repair is not possible, the Consumer is in any case entitled to a reduction in the price or to receive reimbursement of part of the price, commensurate with the value of the item, on return to SGS of the defective Product.

12.4) The guarantee lapses in the event of tampering with the Product by the Buyer or third parties, accidental events, incorrect or improper use or in any case use that is not compatible with the documentation delivered by SGS and the instructions for use, damages, accidents and breakdowns caused by transport carried out by the Buyer, extreme environmental conditions. This fixed-term guarantee is based on careful and responsible use as well as appropriate treatment, both indoors and outdoors.

12.5) In regard to warranty enforcement the following remarks per each item are set.

As for the Lava Stone base plate
The legal guarantee does not cover scratches, cracks, chipping and marks of small or medium size, or minor aesthetic imperfections that may arise in the Lava Stone or on its enameled surface during the normal use in accordance with the instructions for use provided by SGS; the aforementioned marks do not compromise the functionality of the stone and represent characteristics that are already noted and tested, which will in no way affect Health, Performance and Safety.

As for the stainless steel Support-frame
The legal guarantee does not cover any discolouring of the stainless steel support-frame given the direct exposure to the fire, nor rust or oxidation limited to the welded areas, unless the structural or functional integrity is compromised. It is recommend always to make sure that the lower ring of the stainless steel support-frame is positioned (with or without heat diffuser) in permanent central contact with respect to any gas ring.

As for the Borosilicate glass Tray:
The legal guarantee does not cover possible slight aesthetic imperfections due exclusively to the overall craftsmanship in working the Product, or any merely aesthetic damage or alteration found in conditions of use other than from a diligent and normal use of the product, representing features already known and tested, which in no way affect Health, Performance and Safety. It is recommend always to make sure that the lower ring of the stainless steel support-frame is positioned in a permanent central contact with respect to any gas ring.

As for the PTFE Tray
The legal guarantee does not cover possible slight deformations in the geometry of the Product due to the proximity to the heat source as they are already known and tested features, which in no way affect Health, Performance and Safety. It is recommend always to make sure that the lower ring of the stainless steel support-frame is positioned in a permanent central contact with respect to any gas ring.
As for the 100% cotton oven gloves:
the legal guarantee does not cover any damage or wear and tear resulting from normal use or following accidental or voluntary contact with surfaces at a high temperatures.

As for the metal Heat Diffuser
The legal guarantee does not cover and discolouring of the metal heat diffuser given its direct exposure to the fire, nor rust or oxidation of the surface and/or the ring, unless the structural or functional integrity is compromised. It is recommend always to make sure that the lower ring of the stainless steel support-frame is positioned (with or without heat diffuser) in permanent central contact with respect to any gas ring.

As for the Cleaning Kit

The legal guarantee does not cover any damage or wear and tear following to normal use, accidental or voluntary contact with surfaces at a high temperatures.

As for the Betula Wood Cutting Board:
The legal guarantee does not cover any damage or wear and tear following to exclusive contact with raw and cooked foods, including accidental or voluntary contact with metal utensils also at high temperatures.

12.6) As to optimize WARRANTY management and traceability, we do suggest the Purchaser to register the Product by filling in “MY PAMPA” form below, within 20 days from delivery date along with a copy of the original invoice which can be submitted in an electronic format (e.g.: scanned copy, photograph, etc.). In the event of being unable to register online, the Buyer will have have to submit an eMail to customerservice@pampalavastone.com, indicating the Identification Number on the Declaration of Conformity (DCIN) delivered with the PAMPA Set Product, reporting any evidence no later than 20 days from date of its delivery.

13. Material published on the Website
13.1) The materials published on the Website www.pampalavastone.com, such as trademarks, information, texts, advertising materials, music, audio-video materials and in general the Website and its contents are protected by the copyright law and the Industrial Property Code, and therefore any reproduction of the same, either total or partial, is prohibited. The <PAMPALAVASTONE> brand is owned by SGS and is protected by the rules on intellectual property and unfair competition, therefore any use that is not authorised in writing is prohibited.
13.2) The Buyer may not modify, reuse, copy, distribute, transmit, reproduce, publish, grant under licence, create derivated copies, sell or assign, or in any case use for any commercial purpose, any information, software, product or service obtained and/or made available over the www.pampalavastone.com Website.
13.3) SGS does not guarantee that the functional aspects of the Website or its contents are fee of errors or that this Website or the server that makes them available are free of viruses or other harmful components. We always advise all Internet users to ensure that they have installed an updated antivirus software.

14. Protection of personal data
14.1) SGS is the owner of the data processing of all personal data of the Buyer (hereinafter “data subject”) contained in the purchase orders sent to ordering@pampalavastone.com and collected in the performance of the relevant supply contracts, or in the registration form. The processing will be based on principles of correctness, lawfulness and transparency, protecting the privacy and rights of the data subject. SGS deals with the following types of common data: name, surname, locality, address, country, telephone number of the data subject and related e-mail address (in the latter case, the e-mail address is acquired during registration / account creation). The processing of personal data will take place as a result of the sales contract, including the related pre-contractual phase and to pursue the following purposes:

1. (legal basis – contractual purposes – obligatory): to allow the filling of purchase orders received over the Website <pampalavastone.com> by SGS and for the execution of the related supply contracts; therefore any refusal to supply them, in whole or in part, or the failure to authorize their treatment and / or their communication to third parties involved in such activities may result in the impossibility on the part of SGS to fill the purchase orders received and to execute the relative supply contracts; the legal basis of the processing is the supply contract, including the phase preceding its conclusion.

The processing of personal data will take place further to consent from the data subject and for the furtherance of the following purposes:
2. (legal basis – marketing – newsletter – facultative): to allow the sending of promotional newsletters. This purpose may be pursued only with the express consent of the data subject who has registered on the Website. Therefore, any refusal to provide consent to the processing of data for the aforementioned purposes, in whole or in part, will result in the impossibility of SGS to send the promotional newsletter; the legal basis of the processing is the consent to the processing of data given by the data subject.
3. (lawful purposes): in all cases listed under 1) and 2) above in order to comply with the resulting legal obligations.

14.2) The personal data will be provided :
in relation to purposes n. 1) and 3) to: the courier for the shipment, service and content providers (providers of electronic and telematic communication services), professionals providing judicial or extrajudicial assistance in matters concerning the contract with the Buyer;

in relation to purposes n. 2) and 3) to: service and content providers (providers of electronic and telematic communication services).
14.3) SUMMIT GLOBAL SUPPLIES S.R.L. is the Data Controller. You may contact the data controller through the data processor sending the request to the email address: info@summittglobalsupplies.com

14.4) The processing of the aforementioned data will be carried out by persons in charge and by those who have been formally identified who will use instruments and supports – paper, magnetic, computerized or telematic – suitable for guaranteeing security and confidentiality. The processing may also be performed through automated tools for storing, managing and transmitting the data. The processing does not involve automated decision-making processes (profiling).

14.5) In relation to personal data, the data subjects can send a written notice to SGS to the following e-mail address: admin@pampalavastone.com, and can:
– request SGS, as owner of the data processing, to access his/her personal data, correct or cancel the same, or limit the processing or oppose the same and make a claim to a controlling body (ex arts. 15, 16, 17, 18, 19, 21 EU Regulation 679/2016);
– receive in a structured format, commonly used and legible from an automatic device, the personal data that regard him/her provided to a data controller and the right to transmit such data to another data controller without impediment by SGS (so-called “data portability right” ex art. 20 EU Regulation 679/2016);
– not be subject to a decision based solely on automated processing, including data profiling, that produces legal effects regarding him/her or that affect the data subject significantly (ex art. 22 EU Regulation 679/2016);
– revoke consent at any time without prejudicing the lawfulness of the processing when the same is based on the consent given (ex art. 8, par. 3, EU Regulation 679/2016);
The data subject is entitled, in order to safeguard his/her rights to present a claim to the Italian Data Protection Authority (Garante per la protezione dei dati personali).
14.6) Personal data will not be divulged or transferred to third countries or international organizations.
14.7) All personal data collected by SGS in relation; to purpose 1) are stored until the end of the term of the Product guarantee after which date the data will only be stored in order to comply with obligations at law ; to purpose 2) are stored until the revocation of consent by the data subject.

15. Place where the Sale occurs
15.1) The sale is deemed for all purposes to have occurred in Siracusa at the registered office of Summit Global Supplies S.r.l.

16. Applicable Law and Competent Court
16.1) These general terms and conditions of sale are subject to Italian law.
16.2) Any disputes that may arise regarding the performance and/or interpretation and/or validity hereof or in relation to any issue connected with the same shall be subject to the exclusive jurisdiction of the Italian courts.
16.3) Save as above, in the case in which:
the Buyer is considered by Legislative Decree n. 206 dated 06/09/2005 (Consumer Code), as a Consumer, the competent court is that of the place in which the Buyer (Consumer) has his residence or domicile, if within the Italian State;
the Buyer, despite being a Consumer, is not resident or domiciled in the Italian State, the competent court in all disputes relating to the aforementioned conditions is that of the Court of Siracusa.

According to and for the effects of art 1341 and 1342 Italian Civil Code, the following clauses of the General T&Cs of Summit Global Supplies S.r.l are expressly accepted: 2.1. letter f), 3.1, 3.3, 4.4, 4.5, 4.6, 4.7, 4.8, 6.1, 6.6, 9.4,9.5, 9.6, 11.1, 11.2, 11.3, 11.4, 11.5, 12.4, 12.5, 13.2, 13.3, 16.1, 16.2, 16.3.

I warrant that I have read the Personal Data Processing Notice of Summit Global Supplies S.r.l and consent to the processing of my personal data (common) for the purposes of performing the sales contracts entered into online.
